Welcome to Preloved Uniforms (“we”, “us”, “our”, “the Platform”). By accessing or using our website at www.preloveduniforms.co.za, you agree to be bound by these Terms & Conditions. Please read them carefully before using our Platform.
These Terms & Conditions constitute a legally binding agreement between you and Preloved Uniforms in accordance with the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”) and the Consumer Protection Act 68 of 2008 (“CPA”).
2. About Us
Preloved Uniforms is an online marketplace that connects buyers and sellers of preloved school uniforms, textbooks, and educational supplies in South Africa.

3. Who Can Use the Platform
By using this Platform, you confirm that you are:
- At least 18 years old, or using the Platform under the supervision of a parent or legal guardian
- Legally capable of entering into binding contracts under South African law
- Not prohibited from using the Platform under any applicable law
4. User Accounts
- You must register an account to buy or sell on the Platform
- You are responsible for maintaining the confidentiality of your login credentials
- You must provide accurate, current, and complete information during registration
- You must notify us immediately of any unauthorised use of your account
- We reserve the right to suspend or terminate accounts that violate these Terms
5. Buyers
5.1 Placing an Order
By placing an order on the Platform, you make an offer to purchase an item. The contract is formed once the seller accepts the order and payment is confirmed.
5.2 Pricing
All prices are displayed in South African Rand (ZAR) and include VAT where applicable. A R30 buyer protection fee applies to each transaction.
5.3 Cooling-Off Period
In accordance with section 44 of ECTA and the CPA, buyers have the right to cancel a purchase within 7 business days of receiving the item, provided the item is returned in its original condition. This right does not apply to items that have been used or damaged after delivery.
5.4 Payments
All payments are processed securely through our payment gateway. We do not store your card details. Funds are held in escrow until the buyer confirms receipt of the item.
5.5 Delivery
Delivery is managed through BobGo courier services. The buyer is responsible for the courier fee. Delivery timelines are estimates only and we cannot guarantee specific delivery dates.
6. Sellers
6.1 Seller Registration
Sellers must register and verify their account before listing items. By registering as a seller, you confirm that:
- You are the rightful owner of the items you list
- All items are accurately described and honestly represented
- Items are in the condition stated in the listing
6.2 Commission
Preloved Uniforms retains 20% of each successful sale as a platform fee. Sellers receive 80% of the sale price once the buyer confirms receipt.
6.3 Listings
- Listings must include clear, accurate photos and honest descriptions
- Prohibited items include counterfeit goods, stolen property, or items that are illegal to sell in South Africa
- We reserve the right to remove any listing at our discretion without notice
6.4 Seller Obligations
Sellers must:
- Make items available for collection within the agreed timeframe
- Communicate honestly with buyers and the Platform
- Not engage in any fraudulent or misleading conduct
6.5 Suspension
Sellers who violate these Terms may have their accounts suspended or permanently banned without notice.
7. Platform Role
Preloved Uniforms acts as an intermediary marketplace only. We are not a party to the transaction between buyer and seller. We do not take ownership of any listed items. We are not liable for the quality, safety, legality, or accuracy of any listing.
8. Prohibited Conduct
Users may not:
- Post false, misleading, or fraudulent listings
- Harass, abuse, or threaten other users
- Use the Platform for any unlawful purpose
- Attempt to circumvent our payment system by transacting directly outside the Platform
- Scrape, copy, or reproduce Platform content without our written consent
9. Intellectual Property
All content on this Platform, including logos, text, graphics, and software, is the property of Preloved Uniforms and is protected by South African intellectual property law. You may not reproduce or use any content without our prior written consent.
10. Limitation of Liability
To the maximum extent permitted by law, Preloved Uniforms shall not be liable for:
- Any indirect, incidental, or consequential loss arising from use of the Platform
- Loss or damage resulting from third-party actions, including courier services
- Technical errors, downtime, or data loss
Our total liability to you shall not exceed the amount paid by you in the relevant transaction.
11. Dispute Resolution
In the event of a dispute between a buyer and seller, Preloved Uniforms will attempt to mediate in good faith. If unresolved, disputes shall be referred to the relevant consumer tribunal or court in South Africa. Users may also approach the National Consumer Commission (NCC) at www.thencc.org.za.
12. Changes to These Terms
We reserve the right to update these Terms & Conditions at any time. Changes will be posted on this page with an updated date. Continued use of the Platform after changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of South Africa.
